1. Introduction

We may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the alexmitchellbutchers.com website. The changes will apply to the use of the alexmitchellbutchers.com website after we have given notice.

If you do not wish to accept the new Terms and Conditions you should not continue to use the alexmitchellbutchers.com website.

If you do wish to use the alexmitchellbutchers.com website after the date on which the change comes into effect, your use of the alexmitchellbutchers.com website indicates your agreement to be bound by the new Terms and Conditions.

Most areas of this website are accessible without registering your details with us, but certain areas of this website are only open to you if you register.

2. Registration

To register a customer account on www.alexmitchellbutchers.com you must be over eighteen (18) years of age.

You must ensure that the details provided by you on registration or at any time are correct and complete.

You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.

We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

When you register your details, you will automatically be added into our mailing list. If you decide you do not wish to receive our mailings, then you can unsubscribe using the MailChimp unsubscribe link included in the email.

3. Password and security

Each registration is for a single user only. We do not permit you to share your user name and password with any other person.

Responsibility for the security of any passwords issued rests with you and you will be responsible for all activities and orders that occur or are submitted under your password.

If you know or suspect that someone else knows your password you should notify us by contacting us immediately.

4. Exclusion of services

The services provided by the www.alexmitchellbutchers.com website do not include the provision of computer or other necessary equipment or software to access the alexmitchellbutchers.com website. To use the alexmitchellbutchers.com site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

5. Pricing

Where applicable, all our prices include VAT at the current rates. Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this website.

We always endeavour to provide you with consistency of cuts, weights and sizes. Since our butchers cut our meat by hand, they may have to cut slightly over or under your ordered weight in order to ensure you get the best quality. Where we price our meat per kg, the displayed weight and price are approximations. The final cost of your order may actually be slightly more or less than the original estimated cost of your order. We will aim to get the final order price as close as possible to the estimated order price.

Market prices may fluctuate, therefore, our prices are reviewed from time to time as we consider necessary.

By placing an order with us you agree and accept that the final cost of your order may differ slightly from the original estimated amount at the checkout stage.

6. Ordering & Payment

You are deemed to place an order with us by completing our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.

Our acceptance of an order takes place when you agree to our terms and conditions and submit the order and we receive payment confirmation from our Payment Gateway. When you submit your payment details, your debit or credit card is pre-authorised with the initial estimated order value. In accordance with our Pricing Policy, we will charge your debit or credit card for the actual final order amount once your order has been delivered.  We will not charge when we have notified you that your order has been declined or you have cancelled your order.

Please note:-

Prior to delivery - if your payment method is declined by our Payment Gateway, your order will not be accepted by us.

After delivery - If your payment is declined by Payment Gateway, we will contact you by telephone or email.   It is the customers responsibility to ensure that there is sufficient funds in the account which has been used for payment after order has been delivered. 

If a customer has numerous declined payments over a period of time, they will be reminded that they have ticked the box agreeing to terms and conditions and if they wish to shop with us again, they must ensure they have funds for payment after delivery. This may result in the customer being blocked from our website. 

All offers are subject to availability and while stocks last

We may refuse to accept an order:

(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error;
(d) if you do not meet any eligibility criteria set out in our terms and conditions; or
(e) if you have previously refused or cancelled a delivery.

You can place and edit an order up to 48 hours before your local van delivery slot. For National courier deliveries, this is 48 hours up to day of despatch.

7. Delivery

You must ensure that either you or your representative, whom you authorize to sign on your behalf upon delivery of your order, is at your nominated delivery address at the start of the delivery time slot you selected.

If for any reason you or your representative is unable to be present at the agreed delivery address and time slot, you must contact our online ordering department by email at sales@alexmitchellbutchers.com before 5pm on the day before delivery, or by telephone on 01592 771457 by 10am on the day of delivery, otherwise your order will be dispatched to you.

If we are unable to deliver to you, due to you or your representative not being present or available at the agreed delivery time slot and address, we reserve the right to withhold a non-refundable failed delivery fee, and full value of your order.

Please note that delivery is only completed when your order is handed over to you or your representative in person by us and signed for. This means that we are unable to leave your order anywhere else, for example in a garage or wheelie bin etc.  However, if you request for your fresh order to be put in what you class as a 'safe place', (behind the gate, side of house, in porch, etc) then Alex Mitchell Butchers will not accept any liability. 

A delivery charge may apply to your order, depending on your postcode and value of your order. The charge is subject to any special offer we may apply and may change at any time.

On the occasion that severe weather is adversely affecting local van deliveries, you may be required to collect your order at our shop in Glenrothes.

We cannot guarantee that your order will arrive in your requested delivery slot due to unforeseen circumstances such as road closures, adverse weather etc. In the event that this happens we will contact you to discuss the situation.

Refusal to accept your order upon delivery, whether in the original requested delivery slot or otherwise, will result in the full order amount being charged to your account. Similarly, cancellation of your order in accordance with the terms, below, will result in the full order amount being charged to your account.

8. Cancellation and returns policy

If you wish to cancel all or part of your order, you must notify us by TELEPHONE on 01592 771457  If you are National courier customer, then you must contact the shop the day before despatch.  So if your delivery day is a Friday, despatch is on a Thursday, then you must contact us by 10am on Wednesday morning. 

if you are a local van delivery you must phone the shop on 01592 771457 before 10 am on the day prior to your agreed delivery day.

A late cancellation of your order will result in the full order amount being charged to your account.

If you cancel any items in your order that were ordered or made especially for you, we reserve the right to withhold at least a 50% non-refundable deposit on each of those items.

Any costs of returning goods to us shall be borne by you.

Upon receipt of any returned goods, which we have agreed to accept back, we will give you a full refund of the amount paid for such goods, or an exchange credit as required.

The right to return goods will not apply in the following circumstances: -

(a) in the event that the product has been used
(b) to any products that by their nature have a limited lifespan, such as fresh food

 

The provisions of this clause do not affect your statutory rights.
